01Acceptance of these Terms
Brass & Glass is a gear documentation, valuation, and insurance-reporting platform for photographers. These Terms and Conditions govern access to and use of the Brass & Glass website, application, content, and related services, together referred to as the Platform.
By creating an account or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
If you use the Platform on behalf of a business, studio, or other organization, you represent that you have authority to bind that organization, and “you” includes both you and the organization.
02Definitions
Account means a registered user profile created to access the Platform.
Equipment Records means records you keep about photographic equipment — cameras, lenses, lighting, accessories, and related assets — including serial numbers, purchase details, condition notes, and photographs.
Insurance Documents means insurance-related materials you store on the Platform, such as policy documents, certificates of insurance, receipts, and claims notes.
User Content means information, files, images, documents, and other materials you upload to or enter into the Platform.
03Platform purpose and scope
The Platform helps photographers document the equipment they own. Features include a personal gear locker, serial number and purchase tracking, receipt and document storage, estimated current and replacement values, and insurance-ready inventory reports. The Platform also provides a reference catalog of photographic equipment, comparison tools, and market information such as estimated used values and trade-in references.
The Platform is not an insurance company, broker, agent, or producer; an appraisal or valuation service; a marketplace; a law firm; or an accounting service. It supports administrative organization and record-keeping. It does not replace professional judgment, insurance review, legal review, or formal appraisal.
04Eligibility and accounts
The Platform is intended for users who are at least eighteen years old and capable of entering into legally binding agreements. By using the Platform, you represent that you meet these requirements.
You must provide accurate and current account information, keep your login credentials confidential, and promptly notify Brass & Glass of any unauthorized access or suspected compromise. You are responsible for activity that occurs under your account and for controlling who has access to it.
Brass & Glass may refuse registration, suspend access, require re-verification, or terminate an account if it reasonably believes account information is inaccurate, the account is being misused, these Terms have been violated, or continued access presents a security or legal risk.
05Beta program, subscriptions, and billing
The Platform is currently offered as a beta. Access may be provided by invitation, and subscription tiers may be assigned to accounts for testing purposes without charge. Brass & Glass does not currently collect payment for the Platform.
When paid subscriptions become available, pricing, feature limits, renewal terms, trial terms, and cancellation procedures will be described at checkout and in your account. Unless stated otherwise, paid subscriptions will renew automatically at the end of each subscription period, and you will authorize Brass & Glass and its payment processor to charge applicable fees and taxes to the payment method on file. Fees will be non-refundable except where required by law or expressly stated otherwise. If you cancel, access will continue until the end of the then-current paid period unless otherwise stated.
Brass & Glass may modify pricing, tiers, or feature availability for future billing periods, and will provide advance notice where legally required or commercially reasonable.
06Equipment records and valuation
You may record equipment descriptions, serial numbers, purchase dates, receipts, photographs, condition notes, and related details. You are responsible for the accuracy and completeness of your Equipment Records. Inaccurate or outdated entries may produce inaccurate reports and reminders.
Values shown on the Platform — including estimated current values, estimated replacement values, and used-market references — are estimates provided for informational purposes. Brass & Glass does not authenticate ownership, appraise equipment, verify market value, confirm replacement cost, confirm title, or determine insurability. Estimated values should be independently verified before being relied upon.
Reports generated from your Equipment Records may assist with insurance discussions, claim preparation, or studio administration, but they are not formal appraisals unless separately prepared by a qualified professional.
07Insurance documents and reports
You may store Insurance Documents on the Platform and generate reports that summarize your Equipment Records for insurance documentation. All policy and coverage information on the Platform is supplied by you or imported at your direction.
Brass & Glass does not sell, solicit, or recommend insurance; bind coverage; underwrite risk; adjust claims; interpret coverage; issue certificates of insurance; or act as an insurance carrier, broker, agent, producer, or adjuster. Brass & Glass does not independently verify policy status, coverage limits, exclusions, or whether a policy will respond to a claim.
A report generated by the Platform is a summary of information you provided. It is not proof of insurance, not a guarantee that coverage exists or is adequate, and not a coverage opinion. Reminders about renewals, expirations, or missing information are administrative conveniences only and may be incomplete.
08Your content and our license to operate
You retain ownership of your User Content. You grant Brass & Glass a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display User Content solely to operate, secure, maintain, improve, and support the Platform and to provide services you request.
You represent that you have all rights, permissions, and legal bases necessary to upload and process your User Content, including any personal information, copyrighted material, or third-party documents it contains.
09Privacy and data handling
Brass & Glass treats gear inventories as sensitive information. How we collect, use, protect, and delete personal information is described in our Privacy Policy; our security and data-handling statement covers our technical commitments on encryption and data portability.
Tools to export your data and to delete individual items, documents, or your entire account are available in your account settings.
You are responsible for ensuring that your own use of the Platform — including any third-party or client information you choose to store — complies with applicable law and any agreements that bind you.
10Third-party services and affiliate links
The Platform relies on third-party services such as cloud infrastructure, email delivery, and, when billing launches, payment processing. Third-party services are governed by their own terms and privacy policies. Brass & Glass does not control third-party services and is not responsible for their acts, omissions, availability, or data practices. You authorize Brass & Glass to transmit information to third-party services as necessary to provide requested features or comply with law.
The Platform may display prices, availability, used-market values, and trade-in offers sourced from third-party retailers and services. This information is provided for reference, may be delayed or inaccurate, and should be confirmed with the third party before any transaction.
Some links to retailers and trade-in services may be affiliate links, meaning Brass & Glass may earn a commission on qualifying purchases. Our affiliate disclosure describes these relationships. Affiliate relationships do not determine what equipment appears in the catalog or how it is described.
11Acceptable use
You may not use the Platform to violate law, infringe the rights of others, submit fraudulent information, impersonate others, upload malicious code, interfere with Platform systems, scrape data without authorization, bypass access controls, or compromise the security of the Platform or other users.
You may not use the Platform to create false evidence of insurance, alter insurance documents, misstate coverage, or deceive insurers, brokers, clients, or other third parties.
Brass & Glass may investigate suspected misuse and may suspend accounts, remove content, restrict features, preserve evidence, cooperate with lawful requests, or terminate access where appropriate.
12Intellectual property
The Platform — including its software, design, interface, branding, documentation, gear catalog, and content supplied by Brass & Glass — is owned by Brass & Glass or its licensors. These Terms do not transfer ownership of any Brass & Glass intellectual property.
You receive a limited, revocable, non-exclusive, non-transferable right to access and use the Platform in accordance with these Terms. You may not copy, modify, distribute, sell, reverse engineer, or attempt to derive source code from the Platform, or use Platform materials to create a competing service, except as expressly permitted by law or by written agreement.
13Availability, changes, and beta features
Brass & Glass may update, modify, add, suspend, or discontinue Platform features at any time. The Platform may be unavailable due to maintenance, outages, third-party failures, or security incidents.
Features marked beta, preview, or early access may be incomplete, unstable, changed without notice, or discontinued. While the Platform itself is in beta, this applies broadly: do not rely on the Platform as the sole copy of records that are critical to you. Export tools are provided so that your records remain portable at all times.
Brass & Glass does not guarantee uninterrupted access, error-free operation, or compatibility with all devices, browsers, or systems.
14Disclaimers
The Platform is provided on an as-is and as-available basis to the maximum extent permitted by law. Brass & Glass disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
Brass & Glass does not warrant that the Platform will satisfy any insurance, legal, accounting, tax, regulatory, or business requirement. No oral or written information provided by Brass & Glass creates any warranty unless expressly stated in a written agreement signed by an authorized representative.
15Limitation of liability
To the maximum extent permitted by law, Brass & Glass and its owners, officers, employees, contractors, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost photographs, equipment loss, insurance claim denials, or business interruption.
To the maximum extent permitted by law, the total liability of Brass & Glass for any claim arising from or relating to the Platform or these Terms will not exceed the greater of (a) the fees you paid to Brass & Glass during the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
16Indemnification
You agree to defend, indemnify, and hold harmless Brass & Glass and its owners, officers, employees, contractors, affiliates, suppliers, and licensors from claims, damages, liabilities, losses, costs, and expenses arising from your User Content, your conduct, your misuse of the Platform, or your violation of these Terms, applicable law, or the rights of others.
Brass & Glass may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with that defense. You may not settle any claim in a way that imposes obligations on Brass & Glass without its written consent.
17Termination
You may stop using the Platform at any time and may delete your account through your account settings. Exporting your data before closing your account is recommended; export tools are available in settings.
Brass & Glass may suspend or terminate access if you violate these Terms, fail to pay applicable fees once billing is in effect, misuse the Platform, or create a legal or security risk. Upon termination, you may lose access to account data, subject to export functionality, retention practices, and legal requirements.
Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
18Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law rules. Subject to any mandatory law, legal actions arising from or relating to these Terms or the Platform will be brought in the state or federal courts located in Cuyahoga County, Ohio.
Before filing suit, the parties agree to make a good-faith effort to resolve disputes informally by written notice describing the dispute, the relief requested, and the relevant facts. This informal process does not prevent either party from seeking injunctive relief, protecting intellectual property, or complying with legal deadlines.
19Changes to these Terms
Brass & Glass may update these Terms from time to time. Updated Terms will be posted on this page with a revised version number and effective date, and material changes may also be communicated through the Platform or by email.
Continued use of the Platform after updated Terms become effective constitutes acceptance. If you do not agree to updated Terms, stop using the Platform and, once billing is in effect, cancel any applicable subscription.
